ESY RIGHTS/Derechos

We, the undersigned, are parents, caregivers, and advocates for students with disabilities within the Sahuarita Unified School District (SUSD). We respectfully demand the district honor its legal and ethical obligation to provide Extended School Year (ESY) services to qualifying students with IEPs and 504 Plans.

🛑 Why We Are Petitioning

SUSD is denying or limiting ESY access to students with disabilities, effectively excluding them from summer education and violating federal protections under:

• IDEA (Individuals with Disabilities Education Act)

• Section 504 of the Rehabilitation Act

• ADA (Americans with Disabilities Act)

Extended School Year (ESY) is not optional — it is a right for students whose regression during school breaks significantly affects their progress. Denying these services discriminates against children who need consistency to maintain their skills.

📣 What We Are Demanding:

1. Immediate review and correction of all ESY denials.

2. Transparent criteria shared with families for ESY qualification.

3. Bilingual communication and meetings to ensure all families understand their rights.

4. An open town hall or meeting with the district’s special education department to address parent concerns before summer.

• ESY services help prevent severe regression in academic, social, and functional skills.

• Many children with autism, ADHD, Down syndrome, learning disabilities, and speech delays need continuity.

• Denying access widens the achievement gap and places children at risk.

We believe Sahuarita can be a leader in inclusive, equitable education — but only if it chooses to uphold its responsibilities to all students.

Nosotros, los abajo firmantes, somos padres, madres, tutores y defensores de estudiantes con discapacidades dentro del Distrito Escolar de Sahuarita (SUSD). Por medio de esta petición, exigimos que el distrito cumpla con su obligación legal y ética de ofrecer servicios de Año Escolar Extendido (ESY) a los estudiantes con Planes IEP o 504 que califican.

🛑 ¿Por qué estamos peticionando?

El SUSD está negando o limitando el acceso al ESY a estudiantes con discapacidades, excluyéndolos de los programas educativos de verano y violando sus derechos federales bajo las siguientes leyes:

• IDEA (Ley de Educación para Individuos con Discapacidades)

• Sección 504 de la Ley de Rehabilitación

• ADA (Ley de Estadounidenses con Discapacidades)

El ESY no es opcional — es un derecho para estudiantes que podrían perder habilidades esenciales durante el receso escolar. Negar estos servicios es una forma de discriminación contra quienes más los necesitan.

📣 ¿Qué exigimos?

1. Revisión inmediata y corrección de todas las negaciones al ESY.

2. Criterios transparentes y por escrito para la elegibilidad al ESY.

3. Comunicación bilingüe clara y accesible sobre los derechos de las familias.

4. Una reunión abierta o foro comunitario con el Departamento de Educación Especial para abordar estas preocupaciones antes del verano.

👇 ¿Por qué es importante?

• El ESY ayuda a evitar la regresión severa de habilidades académicas, sociales y funcionales.

• Muchos niños con autismo, TDAH, síndrome de Down, discapacidades de aprendizaje o retrasos del habla necesitan continuidad.

• Negar el acceso agrava la desigualdad educativa y perjudica el desarrollo de nuestros hijos.

Creemos que Sahuarita puede ser un modelo de inclusión y equidad educativa, pero solo si decide cumplir con su responsabilidad hacia todos sus estudiantes.
